Who is the developer?

The developer is Lupin Developments Ltd. All contractual arrangements are between you (the purchaser) and Lupin Developments. 

What am I buying?

You are buying a house on a freehold title. Detailed plans and specifications are available on request and will be attached to the sale and purchase.

How do I secure a house?

To secure a house you must sign a standard NZ Sale and Purchase agreement. This agreement must be reviewed by your solicitor prior to signing. Once you have signed the agreement, the Vendor (Lupin Developments) countersigns the contract and at that time the contract is confirmed (subject to any agreed special conditions).

Do I need to pay a deposit?

After signing a sale and purchase agreement a deposit of 10% is payable. The balance of the purchase price is payable when the house is fully built.

Can the developer terminate a contract or change the price?

Once both parties have signed the sale and purchase agreement the developer is unable to adjust the purchase price. The developer is also unable to terminate a contract without the agreement of the purchaser.

For properties not subject to a contract the prices may be changed at any time.

Can the developer make alterations to the specifications and plans?

There are instances in which legislative changes and Local Territorial Authorities require the Developer to make changes to abide by contractual law, best practice at the time, or because certain materials are not available.

Yes, changes can be made. If materials are changed, they must be of equal value to those shown in the plans and specifications.

Can the developer make changes to the size of the lot?

Through construction it may be necessary to adjust boundaries. Any change to the size or layout of the lot must not materially affect the value or amenity of the lot. If changes are material to value or amenity the purchaser has the option to withdraw.

Can we make changes to the houses?

Changes to the physical layout of the house, whilst possible, are discouraged. Changes to specifications such as kitchens, bathrooms, flooring, heating, tapware and handles, are allowed. After signing a contract A1 Homes will work with you in consultation with the colour consultant to customise your home.

What is a sunset clause?

All contracts include sunset clauses that allow the purchaser the right to terminate the contract if construction is not completed by a certain date. The vendor does not have the same rights of termination under the sunset clause.

What build guarantees are available?

Lupin Developments will be using A1 Homes to build the houses. A1 offer a Master Builders Standard 10 Year Builders Guarantee.

The Master Builders Standard 10 Year Builders Guarantee is designed to provide you with complete peace of mind when embarking on the building of a new house. It covers you for defects in materials and workmanship, structural defects, and rot and fungal decay cover (leaky building).

What services will be supplied

Houses will be connected to the following services:

  • Sewer

  • Power

  • Water

  • Gas

  • Fibre ready

  • Phone

Does the price include all landscaping?

The stated pricing includes fencing and all front yard landscaping. Rear yard landscaping can be completed for an additional fee. The additional cost for rear yard landscaping can be supplied on request.

Why gas hot water?

All houses located at 215 Mill Road will have an instant gas hot water system. This has a number of significant benefits to you as a purchaser including energy efficiency, continuous supply, more constant temperature control and space saving. The gas network also has a Carbon Zero future.

What is double glazed SOLUX-E glass?

All windows include double glazed, Argon filled, Solux-E glass. Solux-E has a microscopically thin, transparent coating that reflects long-wave infrared energy (or heat). It works to minimise heat flow. You’ll stay warmer through winter with less warm air escaping and reduce over-heating in the summer with less heat entering, without the need to use tinted glass.

When will my house be ready to move in?

House construction will vary by house but may take between 7–9 months from contract signing.

Why no renting for 12 months?

It is our preference to sell to home occupiers (people buying to live in our houses). We are preventing renting to deter investors.
